Khan & Associates’ litigation team successfully defends the award of a $ 17 million contract to Gemalto before the Islamabad High Court. The court held that a local agent does not have locus standi to commence litigation in Pakistan where the cause of action accrues to the overseas principal who is not a party in the litigation.
In the context of public procurement, the court ruled that a bidder who participates in the bidding process without questioning its legality is estopped from challenging it at a later stage.
The court found the procedure for the award of the contract fair and transparent. In appeal, the Supreme Court of Pakistan upheld the decision of the High Court of the award of the contract to Gemalto.
